Alberta Estoppel Certificate for Sale of Condominium

An Estoppel Certificate is a signed statement certifying that the facts set out in the Certificate are correct. Delivery of the Estoppel Certificate estops the purchaser from claiming a different set of facts at some later time.The Estoppel Certificate is prepared by the condo association on behalf of the seller, and certifies that:
- the seller is not behind in condo fees or other payments owing to the condominium corporation,
- insurance is in place on the condo building,
- the by-laws of the condominium corporation are registered,
- the common property has not been mortgaged or transferred,
- any other relevant information required by the purchaser and the mortgage lender prior to closing the sale.
