Canada Restrictive Covenant re: Trees
Canadian land developers, use this template to draw up a Restrictive Covenant re Trees, which will be registered on title to the land making up a residential subdivision.
The Restrictive Covenant sets out the restrictions governing the height, appearance, pruning and removal of trees and shrubs in a subdivision which will be developed on the land. The Restrictive Covenant runs with the land, and the rights of the developer under the covenant will transfer to the new owners of the lots as they are developed and sold.
